1. Definitions

'User': Any natural or legal person who accesses or uses the Site.

'Services': The features offered by Noleggiamela.com, including rental contract management, vehicle and customer entry, archiving, and other related features.

2. Acceptance of Terms

By using the Site, the User agrees to comply with these Terms of Use. If you do not agree with them, please do not use the Site.

3. Description of Services

Noleggiamela.com offers management software for rental companies, with the following main features:

• Contract Management: Intuitive creation and management of rental contracts, with automatic filling for existing customers.
• Vehicle Entry: Quick addition of new vehicles to the fleet, with the possibility of entering deadlines for inspections and insurance.
• Customer Management: Entry and archiving of customer data, including the ability to save documents such as driver's licenses.
• Contract Archive: Easy access and search of rental contracts, with functions for fine management and contract reprinting.
• Premium Fleet: Detailed monitoring of vehicles, with usage statistics and the ability to associate images with each vehicle.
• Customization: Creation of personalized contract formats to adapt to the specific needs of the company.

3.1 Responsibility regarding Cargos contracts

Noleggiamela is limited to transmitting all rental contracts through the Cargos portal, guaranteeing their creation and full visibility in the platform's contract list. It is specified that Noleggiamela is not responsible for any delays, malfunctions of the Cargos portal, or lack of confirmation of contracts by the Cargos platform. In such cases, the contract remains accessible in the contract list and the user has the right to transmit it directly through the official Cargos platform, without this involving any liability for Noleggiamela.

3.2 Management and transmission of fine notifications

As part of the functions dedicated to the management of administrative penalties, Noleggiamela.com provides the User with a system for archiving fines, through which penalties and the related data and documents can be stored.

Noleggiamela.com also provides, through SkilledIn S.r.l., an ancillary function through which an attempt is made to transmit the communication to the competent authority (Municipality, Local Police or other issuing authority) by certified electronic mail (PEC).

Such transmission constitutes exclusively an additional and supplementary service to the main function of managing and archiving fines and does not in any way replace the obligations and requirements incumbent upon the rental company.

Noleggiamela.com and SkilledIn S.r.l. do not guarantee the actual sending, delivery, receipt, registration or processing of the communication by the recipient authority. The User is therefore required to independently verify the successful outcome of the communication and, in particular, to check their own PEC mailbox for any replies, communications or requests from the competent authority and to fulfil any necessary requirements.

The following methods are available for the ancillary service of transmitting communications to the authority.

Sending via our PEC

Under the standard method, the communication prepared through Noleggiamela.com is transmitted using a PEC mailbox registered to SkilledIn S.r.l.

Il modulo di delega è disponibile cliccando qui e dovrà essere compilato, sottoscritto dal titolare o dal legale rappresentante dell'impresa e trasmesso secondo le modalità indicate nella piattaforma. In assenza di una delega validamente compilata e sottoscritta, il servizio di trasmissione tramite la PEC di SkilledIn S.r.l. non potrà essere attivato.

Noleggiamela.com and SkilledIn S.r.l. cannot guarantee that the communication will actually be received, accepted, registered or processed by the recipient authority.

The outcome of the transmission may depend on numerous factors beyond the control of Noleggiamela.com or SkilledIn S.r.l., including, by way of example and without limitation:

• the User entering an incorrect, incomplete or outdated PEC address;
• the recipient PEC mailbox being full, inactive, revoked or unavailable;
• the recipient authority not accepting communications transmitted through automated systems or originating from a PEC address other than that of the company concerned;
• filters, restrictions or configurations adopted by the recipient authority or its PEC service provider;

The User remains solely responsible for the accuracy, completeness and truthfulness of the data entered into the platform, as well as for identifying the recipient authority and the PEC address used for transmission. Noleggiamela.com and SkilledIn S.r.l. do not carry out any verification regarding the accuracy, currency, validity or operational status of the recipient authority's PEC address, nor are they required to verify any changes or service disruptions.

The User is therefore required to verify in advance that the PEC address of the Municipality or competent authority is correct, up to date and suitable for receiving the communication. Any consequences arising from the use of an incorrect, outdated, inactive, revoked, full or otherwise unsuitable PEC address shall remain exclusively the responsibility of the User.

Sending directly from the User's PEC

In order to increase the likelihood that the communication will be correctly received and processed by the recipient authority, Noleggiamela.com allows the User to configure transmission directly from their own PEC mailbox.

The User may proceed independently by clicking here and completing the appropriate form, in which they may enter their PEC credentials and, where necessary, the relevant OTP code and any additional data required for configuration.

Once the configuration has been successfully completed, communications will be transmitted directly from the User's PEC address.

This method may increase the likelihood that the communication will be correctly received and processed by the recipient authority. However, it does not constitute a guarantee of sending, delivery, receipt, registration or processing of the communication.

Noleggiamela.com and SkilledIn S.r.l. do not perform daily checks on the User's PEC mailbox and cannot constantly verify its status, the presence of any errors, blocks, authentication requests, changes to credentials, expirations, service provider restrictions or other circumstances that may affect the proper functioning of the PEC mailbox.

Assistance service for configuring the User's PEC

If the User does not wish to carry out the configuration described above independently, they may request a dedicated assistance service from SkilledIn S.r.l. by clicking here, upon payment of the fee indicated on the relevant page.

In this case, the User will provide the credentials for their PEC mailbox, any required OTP code and any additional necessary data, and SkilledIn S.r.l. will, on behalf of the User, complete the necessary form and configuration to enable communications to be sent directly from the User's PEC.

In this case as well, the direct use of the User's PEC may increase the likelihood that the communication will be correctly received and processed by the recipient authority, but it does not in any way constitute a 100% guarantee of the actual sending, delivery, receipt, registration or processing of the communication.

Responsibility and verification of communications

Regardless of the method chosen from those described above, Noleggiamela.com and SkilledIn S.r.l. do not guarantee the actual receipt or processing of the communication by the Municipality or other recipient authority.

In particular, even when communications are sent directly from the User's PEC as described in points 2 and 3, Noleggiamela.com and SkilledIn S.r.l. cannot monitor the User's PEC mailbox on a daily basis, its proper functioning or the actual processing of the communication by the recipient authority.

The User therefore remains responsible for verifying that the communication has been correctly transmitted and received, by checking their PEC mailbox, the relevant acceptance and delivery receipts and any error or non-delivery messages.

The use of the functions offered by Noleggiamela.com does not replace the obligations imposed by applicable legislation on the rental company and does not constitute certification or a guarantee that such obligations have been fulfilled.

The User also remains responsible for the accuracy, completeness and truthfulness of the data entered into the platform, for identifying the recipient authority and for the accuracy of the PEC address provided.

By using any of the methods described above, the User shall indemnify and hold harmless SkilledIn S.r.l., Noleggiamela.com and their respective directors, employees and collaborators from any liability, claim for damages, penalty, damage, cost or demand arising from the failure or delay in transmitting or receiving communications, the use of incorrect or outdated data or PEC addresses, problems relating to the User's or recipient authority's PEC mailbox, the User's failure to verify the outcome of the communication, or any other circumstances not directly attributable to wilful misconduct or gross negligence on the part of SkilledIn S.r.l.

4. Registration and User Responsibility

Information provided by the User: During registration and use of the Site, the User agrees to provide accurate, complete, and updated information. Noleggiamela.com is not responsible for the veracity of the data entered by its members.

False declarations: The entry of false, inaccurate, or incomplete information is prohibited and may lead to the suspension or cancellation of the User's account.

Improper use of the system: It is forbidden to use the Site for illegal purposes or purposes not compliant with these Terms of Use, including the creation of false contracts or the entry of untruthful data.

Right of cancellation: Noleggiamela.com reserves the right to suspend or delete the account of any User who: enters false or unverifiable data; misuses the system; performs activities that compromise the security of the Site or violate applicable laws.

Non-Payment and Service Suspension

Non-payment, suspension and termination

1. 1. The Customer undertakes to promptly pay all amounts due for fees, additional services, optional features, supplementary modules, or any other activated service.
2. 2. In the event of non-payment, even partial, after 7 (seven) days from the deadline indicated in the invoice or equivalent accounting document, the Company reserves the right to:
   • a) a) suspend access to optional features or modules subject to outstanding payment;
   • b) b) suspend full access to the platform, including all active services, in case of serious or repeated breach;
   • c) c) limit access to data consultation only, without the possibility of entry or modification.
3. 3. Suspension may occur without further notice beyond the reminder sent via e-mail or Certified E-mail (PEC) to the contact details provided by the Customer.
4. 4. Reactivation of the service will be subject to full settlement of the amounts due.
5. 5. The Company reserves the right to proceed with debt collection and contract termination pursuant to art. 1456 of the Italian Civil Code in case of persistent non-fulfillment.
6. 6. The Customer acknowledges that suspension for non-payment does not constitute a breach by the Company nor does it entitle the Customer to compensation, indemnity, or refunds.

5. Security and Data Protection

Login credentials: User credentials are protected by advanced encryption and never saved in plain text. Protection against unauthorized access: The User is responsible for the confidentiality of their credentials.

Permitted Use

The User undertakes to use the Site and Services exclusively for legitimate purposes and in compliance with these Terms of Use. It is prohibited to:

• Use the Site in a way that violates applicable laws or regulations.
• Enter false data or manipulate information for fraudulent purposes.
• Interfere with the operation of the Site or Services.

7. Intellectual Property

All content on the Site is the property of Noleggiamela.com or its suppliers and is protected by Italian and international copyright laws.

Limitation of Liability

Noleggiamela.com is committed to providing high-quality Services, but does not guarantee that the Site or Services will be error-free or uninterrupted. Noleggiamela.com shall not be liable for direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Site or Services.

Changes to Terms of Use

Noleggiamela.com reserves the right to modify these Terms of Use at any time. Changes will be communicated via the Site and will take effect immediately. Continued use of the Site after such changes implies acceptance of the new Terms of Use.

Governing Law and Jurisdiction

These Terms of Use are governed by Italian law. For any dispute arising from the interpretation or execution of these Terms, the court of Naples shall have jurisdiction.
